erms of Service and Sale

Last updated: October 6, 2026

Overview

Welcome to Toma Grin, an online store selling physical prints of paintings by artist Toma Grin. At tomagrin.art, you can order prints signed by the artist, shipped from Ukraine to the destinations available at checkout.

In these Terms, “Toma Grin”, the “store”, “we”, “us”, and “our” refer to the store and the seller operating under this trading name. The “Website” means our online store and its related features. Our store is powered by Shopify.

These Terms govern your use of the Website and the placement and fulfilment of orders. Before making a purchase, please also read our Privacy Policy, Return Policy, and Shipping Policy.

By placing an order, you agree to the terms of sale made available before you place it. Our Privacy Policy explains how personal data is processed; acknowledging that policy does not replace separate consent where consent is required by law.

Nothing in these Terms excludes or limits mandatory consumer rights under applicable law. If these Terms conflict with those rights, the mandatory provisions of the law prevail.

1. Website Access and Accounts

To place an order independently, you must have the necessary legal capacity under applicable law. If you are a minor, your purchase must be made by, or with the involvement of, your parent or legal guardian as required by law.

Please provide accurate and current information needed for payment and delivery, including the recipient’s name, email address, delivery address, and telephone number where required by the carrier. If you order a print for someone else, please ensure that you are entitled to share their information for delivery.

If you use a customer account, keep your login details confidential and notify us if you suspect unauthorised access. Do not use another person’s account without their permission.

2. Our Products

We sell physical art prints signed by Toma Grin. A print is a printed reproduction of an artwork, rather than the original hand-painted work.

The size, material, white borders, included items, and other specifications are stated on the relevant product page. Where an edition size or individual print number is specified, this information is also included in the description. Frames, mounts, and interior accessories shown in photographs are not included unless the product description expressly states otherwise.

We aim to represent our prints accurately. Minor differences between an on-screen image and the physical print may result from screen settings, lighting, and the printing process. The placement and appearance of the handwritten signature may vary slightly between prints. This does not release us from our obligation to supply goods that match their description and meet mandatory quality requirements.

Our range, available sizes, and stock levels may change. Changes to a product page after an order has been accepted do not alter the agreed specifications of that order without your consent.

3. Placing and Accepting Orders

Before paying, please check your chosen print, size, quantity, delivery address, and shipping cost.

By placing an order, you make an offer to purchase on the stated terms. We confirm acceptance of your order by email. If a notification expressly states that it only acknowledges receipt of your request and that further confirmation is required, please wait for that confirmation. Payment is made using a method available at checkout.

We may decline an order if a product is unavailable, delivery is not possible, there are reasonable grounds to suspect fraud, a material technical error has occurred, or fulfilling the order would be prohibited by law. If this happens, we will notify you. If payment has already been received, we will arrange a refund of the corresponding amount for the unfulfilled portion of the order.

If you need to correct information or cancel an order, email tomagrin.art@gmail.com as soon as possible. Whether changes can be made depends on the stage of preparation and dispatch. This does not limit your statutory right to withdraw from a purchase or return goods.

4. Prices, Payments, and Taxes

The product price, payment currency, selected shipping cost, and amounts we charge for the purchase are displayed before you confirm your order. Discounts apply on the terms shown when you place your order. Later price changes do not increase the price of an order we have already accepted.

Use only payment methods that you are authorised to use. Payments are processed through the providers available at checkout. Do not send full payment card details or card security codes by email.

International deliveries may be subject to import taxes, customs duties, and carrier clearance fees. Before purchase, we indicate whether these charges are included in the order total or may be charged separately. If they are not included and are payable by the recipient under the applicable rules, customs authorities or the carrier may collect them. We do not transfer charges to the buyer where the law makes them the seller’s responsibility.

Your bank or payment service may apply its own exchange rates and fees. These are determined by the relevant provider.

5. Shipping and Delivery

Prints are shipped from Ukraine. Delivery availability, methods, and costs depend on the destination country, address, and the sizes and quantities of prints ordered, and are shown at checkout. Further details are set out in our Shipping Policy.

Order preparation time and transit time are separate periods. Estimated times are provided on the product page, at checkout, or in the Shipping Policy. If a specific deadline has been agreed between the parties, that deadline applies.

We package prints for transport and provide tracking details where the selected delivery method includes tracking. Customs clearance, route restrictions, and other external circumstances may affect delivery times. If there is a significant delay, please contact us so that we can check the status and offer a solution that respects your rights.

When goods are delivered using a method offered by the store, the risk of accidental loss or damage passes to a consumer customer once the goods are physically received by that customer or their designated recipient. Handing the parcel to a carrier does not, by itself, end our obligations to that customer.

If an address is incorrect, or a parcel is not collected and is returned to us, we will contact you to agree on the next steps. Any potential redelivery costs will be discussed separately and will apply only where permitted by law. A parcel being returned to the sender does not, by itself, mean that the entire amount paid is automatically forfeited.

6. Copyright and Use of Images

Copyright in Toma Grin’s artworks and their images remains with the artist or the relevant rights holder. Rights in other Website materials belong to their lawful owners.

When you purchase a print, you acquire the physical copy. The purchase does not transfer copyright or grant a licence to make copies, print products bearing the image, or otherwise commercially exploit the artwork.

You may use your purchased print for personal purposes, display it in your space, or give it as a gift. Reproducing the image or using it on commercial products requires permission from the rights holder, except where expressly permitted by law.

The names, logos, and other identifiers of Toma Grin, Shopify, and third parties belong to their respective rights holders. Their appearance on the Website does not grant permission to use them in a way that suggests an unauthorised partnership or endorsement.

7. Third-Party Tools

Some store features are provided by third-party services, such as payment systems and tracking services. Additional terms from the relevant provider may apply to their use.

We do not operate independent services and cannot guarantee their continuous availability. However, using a third-party provider does not release us from our obligations as the seller in relation to your order.

8. Links to Other Websites

The Website may contain links to Instagram, carriers, payment services, and other external resources. These resources may have their own terms and privacy policies.

We do not control the content of independent websites. You may still contact us about orders placed with Toma Grin, even where a third-party service was used for payment or delivery.

9. Our Relationship with Shopify

Toma Grin is powered by Shopify, which enables us to provide the online store’s features. However, purchases from our store are made directly from the seller trading as Toma Grin, not from Shopify.

Shopify provides the technology platform and is not the seller of our prints. Questions about products, order fulfilment, delivery, and returns should be directed to us.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for our obligations concerning the sale of goods and are released from related claims. This provision does not limit liability that cannot legally be excluded or your mandatory consumer rights.

10. Personal Data

Our processing of personal data is described in our Privacy Policy. Information about Shopify’s processing is available in the Shopify Consumer Privacy Policy.

To fulfil your order, necessary information may be shared with Shopify, payment providers, carriers, and, where required for international shipping, customs authorities and customs clearance intermediaries. Recipients of this information may be located in other countries. Details, legal bases for processing, and ways to exercise your rights are set out in our Privacy Policy.

11. Reviews and Feedback

If the Website allows reviews, please provide truthful information about your experience. Do not post other people’s personal data, unlawful materials, threats, spam, or content that infringes third-party rights.

By posting a public review, you permit us to display it in the store together with your chosen public name. If your review includes a photograph, you must have the right to publish it. We will seek separate permission before using private correspondence or your photographs in advertising outside their original context.

We may remove spam, unlawful materials, and reviews that breach these rules. A negative opinion about a product is not, by itself, a reason to remove a review.

12. Errors and Inaccuracies

We may correct typographical and technical errors in descriptions, prices, stock information, and shipping calculations.

If a material error affects your order, we will contact you and explain the situation. Correcting an error does not entitle us to charge an additional amount automatically or substitute a product without your consent. Further fulfilment, amendment, or cancellation of the order will take account of the agreed terms and applicable law.

13. Website Use Rules

You must not use the Website for fraud, unlawful payments, copyright infringement, distributing malicious code, collecting other people’s personal data without a lawful basis, or interfering with the store’s operation.

You must not bypass security or access restrictions, impersonate another person, or use automated tools to carry out actions that breach these rules. The use of assistive technologies is not, by itself, a violation.

Where there are reasonable indications of misuse, we may restrict access or suspend an account. These measures do not cancel the customer’s rights in relation to orders already paid for.

14. Returns, Withdrawal, and Damaged Prints

Our returns and refunds procedures are described in our Return Policy. That policy applies alongside mandatory consumer rights under the law.

To notify us that you wish to withdraw from a purchase, request a return, or report a problem, email tomagrin.art@gmail.com with your order number and the details of your request. Contacting us first helps you obtain the correct instructions and return address; it does not mean that exercising a statutory right of withdrawal depends on our permission.

If EU or UK distance-selling rules apply to your purchase, you can generally notify us of your withdrawal within 14 days after receiving the goods and then send them back within the period required by law. Exceptions apply only where provided for by law.

The store does not treat an ordinary artist’s signature on a standard print as, by itself, personalisation that excludes returns. If we separately agree to make a product to your individual specifications or add a personal inscription, any special conditions affecting withdrawal from that purchase will be disclosed before you order. This does not affect your rights in relation to defective goods.

If a print is damaged, you receive the wrong item, or your parcel has not arrived, please let us know. Where possible, include photographs of the print, packaging, and shipping label, and keep the packaging for inspection by the carrier. The absence of a photograph or original packaging does not, by itself, remove your statutory rights. Depending on the circumstances and legal requirements, a solution may include replacement, a price reduction, or a refund.

Return shipping costs and the amounts to be refunded depend on the reason for the return, the terms disclosed before purchase, and applicable law. Refunds are made using the original payment method unless another permitted method is agreed with you. We do not replace a mandatory monetary refund with store credit without your consent.

15. Termination of Access

You may stop using the Website at any time. We may restrict access if these Terms are breached, there is a security threat, or doing so is necessary to comply with the law.

Termination of access does not end obligations relating to accepted orders, refunds, or valid claims. Provisions concerning copyright, personal data, dispute resolution, and other matters that by their nature remain relevant will continue to apply to the extent appropriate.

16. Product Quality and Website Operation

We undertake to supply goods that match the agreed description and meet mandatory quality requirements. These Terms do not exclude statutory guarantees or the remedies available to customers for defective goods.

We do not guarantee that the Website will be continuously available or free from technical errors. General informational materials do not constitute a promise about a particular product’s specifications unless those specifications are stated in its description or separately agreed at the time of purchase.

17. Liability

Each party is responsible for breaches of its obligations in accordance with applicable law.

We are not responsible for the consequences of customer actions unrelated to a breach by us, such as damage to a print caused by improper handling after receipt. This does not limit claims concerning defects that were already present in the goods.

Nothing in these Terms releases us from liability for intentional misconduct, fraud, or other circumstances where liability cannot legally be excluded or limited.

18. Third-Party Claims

If a user’s unlawful actions or submitted content infringe third-party rights, liability is determined by applicable law. Compensation for loss may be payable where the legal grounds are established and a causal link between the breach and the loss is demonstrated.

These Terms do not require a customer to reimburse any costs incurred by the store or Shopify merely because the customer visited the Website or made a purchase.

19. Severability

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply where permitted by law. An invalid provision does not replace or limit mandatory consumer rights.

20. Terms Applicable to a Purchase

The terms of a particular purchase are determined by this document, the description of the ordered product, the information provided at checkout, the applicable store policies, and any separately agreed terms.

Our decision not to exercise a right in one instance does not waive that right in the future. Statutory rules protecting consumers continue to apply when interpreting these Terms.

21. Assignment of Rights and Obligations

Rights or obligations under the contract may be transferred only as permitted by law and without reducing the customer’s protections. If fulfilment of an order is transferred to another party and the law requires your consent or notification, the relevant consent will be obtained or notice provided.

Engaging a carrier, payment provider, or other contractor does not automatically release the seller from its obligations to the customer.

22. Governing Law and Disputes

These Terms and contracts of sale are governed by Ukrainian law, subject to applicable rules of private international law.

If you are a consumer in another country and that country’s mandatory consumer protection rules apply to your purchase, the choice of Ukrainian law does not deprive you of that protection.

For questions or complaints, email tomagrin.art@gmail.com. We will review your request and seek to resolve the dispute. You retain the right to refer a matter to a competent authority or court under applicable law; these Terms do not impose exclusive jurisdiction that restricts statutory consumer rights.

23. Headings

Headings and numbering are included for convenience and do not change the meaning of the provisions in this document.

24. Changes to These Terms

The current version of these Terms is published on this page with an updated date. Material changes will be brought to users’ attention as required by law.

Orders already placed remain subject to the version in effect when the relevant contract was concluded, unless the parties lawfully agree otherwise. Updating this page does not, by itself, retrospectively change the terms of an accepted order.

25. Disclaimer

This store is integrated with the Western Bid™ e-commerce platform, and Western Bid, Inc. is the Merchant of Record for all purchases made in this store. Therefore, you will see "WESTERN BID" listed as the payee on your PayPal account and credit card statement.
